SCENPOP · TERMS OF SERVICE
SCENPOP Terms of Service
Last updated: 29 October 2026
Effective date: 29 October 2026
Introduction
Welcome to SCENPOP. SCENPOP is provided by SCENPOP TECHNOLOGY LIMITED, whose address is Room 16, 1/F, Tin Fai Industrial Building, 46 Lai Yip Street, Kwun Tong, Hong Kong (referred to as "we", "us" or "our").
Please read these Terms carefully before using SCENPOP. If you do not agree with any part of these Terms, stop installing or using the service. By registering, signing in or actually using the service, you agree to be bound by these Terms and the SCENPOP Privacy Policy.
Please read these Terms and the applicable rules in full and make sure you understand them, especially the provisions concerning licence restrictions, account responsibilities, service changes, liability boundaries, damages and dispute resolution. We have taken reasonable steps to bring these provisions to your attention.
If you are a minor, you and your parent or guardian should read these Terms and the Privacy Policy together and obtain any consent required by applicable law. Whether guardian consent is required, the minimum age and the appropriate method of confirmation depend on the rules where you live, your age and the actual features of the service. A minor should not provide us with more personal information than is necessary for the service, except where the law provides otherwise.
If a dispute arises from the content or performance of these Terms, the parties should first try to resolve it in good faith. If no resolution is reached, either party may bring proceedings before a court with jurisdiction or complain to an applicable regulator in accordance with law.
These Terms are formed, performed and interpreted under the laws of the Hong Kong Special Administrative Region. This choice of law does not affect mandatory consumer or data-protection rights under the laws of the United Kingdom, Canada or your habitual residence that cannot be excluded by contract, and does not exclude or limit your statutory rights.
You must comply with these Terms, applicable law and the rules we publish through our website or app pages. You must not engage in unlawful, fraudulent or infringing conduct, endanger security or interfere with the service.
Matters not covered by these Terms are governed by applicable law. If these Terms conflict with a mandatory provision that cannot be excluded by contract, that provision prevails.
Please pay particular attention to the highlighted provisions. Before selecting "Agree" or giving equivalent confirmation, make sure you have read and understood these Terms. Your agreement does not remove rights that applicable law gives you.
Article 1 General Provisions on the Parties
These Terms are made between:
1. "We" means SCENPOP TECHNOLOGY LIMITED, the operator of SCENPOP. We provide the products and services described in these Terms through app stores, our website and authorised channels.
2. "You" or "User" means a natural person who registers for and uses SCENPOP under these Terms. You must use the service for personal, non-commercial purposes and are responsible for activity carried out through your account. If you are a minor, Article 9 of these Terms and applicable laws protecting minors also apply.
3. If you obtain, update or manage SCENPOP through Apple App Store, Google Play or another app store, you must also comply with that platform's applicable terms and rules. If these Terms conflict with rules of that platform that cannot be excluded by contract, the platform rules prevail to the extent of the conflict. An app store is an independent service provider; account, system, purchase and refund services provided by the platform are handled under its own rules.
Article 2 Definition of the SCENPOP Software Product
1. SCENPOP is a mobile application that provides features relating to scene creation, editing, saving, display, processing and restoration. The actual features are those provided in the client and pages you use.
2. We or the relevant rights holders own and control the SCENPOP software, service and related content that we provide or use under licence.
3. "SCENPOP Software" includes the client, updates, patches, related documentation and ancillary components that we provide. "SCENPOP Service" means the related services we provide through the internet or other necessary technical means.
4. These Terms do not grant you any ownership of the SCENPOP name, trade marks, logos or brand, and do not authorise you to make statements, commitments or create relationships with third parties on our behalf.
5. We may interpret and enforce these Terms in accordance with their terms and applicable law. No interpretation may expand an express licence, restrict your statutory rights or exclude liability that cannot lawfully be excluded.
Article 3 Definition of SCENPOP Users
1. A natural person who registers for, signs in to or otherwise uses SCENPOP is a "User" for the purposes of these Terms.
2. We protect your personal information and process it only in accordance with the SCENPOP Privacy Policy, your authorisation and applicable law.
3. You must comply with the laws of your country or region and the laws applicable to the service. You must not use the service for unlawful, harmful, fraudulent or infringing conduct or conduct that threatens cybersecurity.
4. You must not use the service to evade the law, infringe another person's rights, compromise service security, circumvent access restrictions or interfere with other users' normal use.
5. You must not impersonate another person, falsify your origin or use names, logos or other identifying information in a misleading way.
6. You must not create accounts in bulk through automated or fraudulent means, or obtain access through false information, proxy services or other circumvention methods.
7. You must not use text, symbols, images or links in your profile or content for unlawful, fraudulent or harassing purposes or to infringe another person's rights.
8. You must not distribute malware, phishing or fraud schemes, or content intended to damage devices, accounts or service security.
9. You must not distribute content that promotes terrorism, violent extremism or incitement to serious violence.
10. You must not distribute content that encourages or assists self-harm, suicide, abuse, exploitation or danger to life or health.
11. You must not create, distribute or request child sexual abuse material, child exploitation material or other content that infringes minors' rights.
12. You must not distribute hateful or discriminatory content or hostility based on protected characteristics, or incite violence against an individual or group.
13. You must not harass, threaten, stalk, intimidate, extort or persistently disturb another person.
14. You must not infringe another person's privacy, likeness, reputation, confidentiality of communications or other lawful rights.
15. You must not collect, copy, disclose or use another person's personal information, account credentials or private material without authorisation.
16. You must not impersonate us, our personnel, another user or a third party, or create a misleading impression of an official relationship.
17. You must not publish false identities, false transactions, false prize claims or deceptive contact information to induce another person to disclose information or property.
18. You must not promote illegal goods, illegal services, gambling, evasion of law enforcement or other clearly unlawful activity.
19. You must not publish material that infringes copyright, trade marks, patents, trade secrets or other intellectual property rights.
20. You must not violate mandatory laws of your country or region, the United Kingdom, Canada or another applicable jurisdiction.
21. You must not engage in conduct that clearly harms public safety, public health or another person's lawful rights.
22. You must not use the service to send unsolicited commercial promotion, spam or large-scale harassment, or use external contact details to disrupt the service.
23. If you provide external contact details in your profile, content descriptions or other content you control, you must not use them for fraud, unlawful solicitation or other unlawful conduct.
24. You must not use external contact channels for unlawful transactions, to circumvent platform security, to impersonate a certification body or to provide false professional advice.
25. You are responsible for your own conduct in accordance with law. If unlawful conduct causes loss for which you are legally responsible, you must compensate the affected person as required by law.
26. If you breach these Terms or applicable rules, we may take reasonable measures based on the nature of the breach, including warnings, removal of unlawful or infringing content, feature restrictions, suspension or account termination.
27. You must not use unlawful tools to submit excessive requests, overload or interfere with the service, or generate abnormal traffic through automation.
28. If you find unlawful, harmful, fraudulent or infringing content or conduct, you may report it using the contact details in these Terms. We will handle the report in accordance with applicable law and the circumstances.
29. Where conduct seriously endangers another person's safety, involves repeated infringement or persistently breaches safety rules, we may suspend or terminate the relevant account and preserve our legal rights.
30. Content you create or save through the service represents your views, not ours. You are responsible for the legality and accuracy of content you create, import or process.
31. Disputes arising from interactions between users should be resolved between those users in accordance with law. We remain responsible where we have a legal duty or are at fault.
32. We will not use your works for commercial promotion, public distribution or sublicensing unrelated to the service without authorisation.
33. You retain your existing rights in content you create. To provide saving, display, processing and restoration features, you grant us only the limited licence necessary to achieve those purposes.
34. This licence does not transfer ownership, and does not include selling or publicly promoting the content, permanent commercial exploitation or sublicensing it to unrelated third parties.
35. You represent and warrant that you have the right to process content you create or import and that the content does not infringe another party's intellectual property, privacy, likeness or other lawful rights.
36. After you stop using the service or delete content, we will retain data only for as long as there is a legal basis, a security need or a necessary technical backup period.
37. If content is the subject of a third-party rights complaint, we may require the complainant to provide reasonably verifiable rights evidence and specific information, and take appropriate measures after lawful verification.
Article 4 Intellectual Property
1. Content in the SCENPOP software and service that we provide or license is protected by copyright, trade mark, patent, trade secret and other applicable laws.
2. We or the relevant rights holders own the SCENPOP name, graphical marks, interface designs and related commercial identifiers. You must not use them without permission in a way that may cause confusion about origin.
3. If you use those identifiers without authorisation, we may require you to stop, restrict access or pursue legal remedies in accordance with law. Any measure must be proportionate to the nature and impact of the conduct and applicable law.
4. If the service contains third-party intellectual property, the relevant third-party terms will be disclosed where appropriate and apply to your use of that material.
5. You may create or import content that you are entitled to use. You must ensure that the content is lawful and does not infringe intellectual property or other rights.
6. You grant us only a non-exclusive, non-transferable limited licence necessary to provide saving, display, processing and restoration. We do not acquire ownership of your content or use that licence for unrelated commercial promotion.
7. All rights not expressly granted are reserved to the relevant rights holders. No implied licence arises merely from use of the service, except for rights that applicable law expressly prohibits us from excluding.
Article 5 SCENPOP Software Licence and Restrictions
1. You should obtain SCENPOP from an app store, our website or another channel authorised by us. We do not guarantee that an app obtained from an unauthorised source or modified by a third party is secure or functions properly.
2. If you comply with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use SCENPOP on devices you lawfully control for personal, non-commercial purposes.
3. This licence is not a sale of the software. The scope of the licence is defined by these Terms, and all rights not granted are reserved.
4. You must not copy, distribute, rent, sell, sublicense, publicly display or make SCENPOP software available over an information network, except where applicable law expressly permits you to do so.
5. You must not reverse engineer, decompile, disassemble, modify, circumvent technical protection or create derivative versions, except where applicable law expressly permits and the restriction cannot be excluded by contract.
6. You must not remove, obscure or alter copyright, trade mark, security or other rights notices, or falsely claim to develop, operate or certify SCENPOP.
7. You must not use unauthorised plug-ins, scripts, robots, automated programs or other technical means to manipulate the service.
8. You must not use the service for unlawful or infringing purposes, to endanger security or to interfere with others.
9. If you breach these Terms, we may revoke the licence, restrict features, suspend the service or terminate your account in accordance with law. We will not restrict your statutory rights beyond what the law permits.
10. Updates to the software or service may be accompanied by new terms, privacy notices or third-party licence conditions. If a change materially affects your rights or obligations, we will provide reasonable notice and obtain consent where required by law.
Article 6 Fees and Virtual Assets
The current version does not charge fees and does not provide memberships, subscriptions, top-ups, payments, points or virtual assets, account-rights trading or virtual property that can be transferred between users.
Article 7 User Account Registration, Use and Security
1. SCENPOP currently supports registration and sign-in only through an email address and a verification code sent to that address. The actual entry points and verification steps are described in the app.
2. You must use an email address that you lawfully control and can continue to access, and ensure that the information is used for your own account.
3. You must provide accurate registration information belonging to you and update necessary information promptly. Do not use another person's email address or impersonate another person.
4. You must protect your email account, verification codes, device and sign-in environment. You must not sell, rent, transfer or lend your account or allow an unrelated third party to use it.
5. If your account is impersonated, you notice unusual sign-in activity or you lose access to your email, contact us promptly through the app or the details in these Terms.
6. To protect account security, we may verify control of your account through steps that are necessary and proportionate to the risk, including sending verification information to the registered email address or checking limited account information.
7. Where verification is necessary, we will use proportionate and non-excessive steps and explain the purpose and necessity of the request.
8. If you ask us to suspend access to an account that shows unusual activity, we may take temporary protective measures after reasonable verification. You should cooperate with checks that can reasonably be carried out.
9. If an account involves transfer, lending, abnormal automation, impersonation or another security risk, we may restrict sign-in or take other proportionate measures in accordance with law.
10. Activity carried out through your account will generally be treated as activity carried out by you. Loss caused by a failure to protect your email, verification codes or device will be handled according to each party's fault and applicable law.
11. If unusual account activity may involve unlawful conduct, we may retain necessary records, assist competent authorities and notify affected users in accordance with law.
12. We will not immediately delete an account merely because you have not signed in for a long time. If we intend to stop providing the service or delete an account because of prolonged inactivity, we will provide advance notice to the extent required by law.
13. You may request account deletion through the app. Deletion is normally irreversible and will be carried out after reasonable notice.
14. Before requesting deletion, you are responsible for preserving any works or materials you wish to keep. Deletion may be delayed for a reasonable period where required by law or by a technical backup cycle.
15. After account deletion, except for information we must retain by law, we will stop collecting personal information for the service and delete or anonymise related data in accordance with the SCENPOP Privacy Policy.
16. If deletion could affect an ongoing legal claim, complaint or security investigation, we may retain relevant information for the necessary period and scope.
17. If we find that an account is used for unlawful conduct, serious breach or conduct that endangers others, we may restrict, suspend or terminate it in accordance with law and explain the reasons and available appeal route.
18. The service currently uses only email verification codes for registration and sign-in. If another sign-in method is added, we will explain the applicable rules before activation and obtain consent where required by law.
Article 8 Protection and Collection of User Information
1. We respect and protect your personal information and process it in accordance with the SCENPOP Privacy Policy, applicable law and your authorisation. Please read the Privacy Policy in full before using the service.
2. We process personal information only where necessary to provide the service, protect security, comply with legal obligations or as otherwise authorised by you.
3. To register and sign in, we process your email address and the information needed to complete verification. We do not request identity material unrelated to the current features.
4. We may process personal information to perform a contract or legal obligation, protect vital interests, with your consent or on another lawful basis. The Privacy Policy explains the applicable basis.
5. If we process information to respond to an emergency, protect life or health or perform a legal duty, we will comply with applicable limits on scope and retention.
6. In accordance with the Privacy Policy, we may use service-operation and troubleshooting information to maintain product security and stability where necessary, transparent and proportionate to the purpose.
7. Except for processing described in the Privacy Policy, disclosure required by law or disclosure with your consent, we do not provide, disclose or trade your personal information to unrelated third parties.
8. We require service providers processing personal information on our behalf to use appropriate security measures and process information only under our instructions and applicable law.
9. We determine account-verification and information-security measures according to necessity, proportionality and security risk. We do not make additional proof procedures a general condition of use. If verification changes in future, we will update the Privacy Policy in accordance with law.
10. You may exercise applicable rights to access, correct, delete, withdraw consent, restrict or object to processing in accordance with the Privacy Policy.
11. The SCENPOP Privacy Policy is the complete statement of personal-information processing and your rights. If these Terms and the Privacy Policy differ on personal-information processing, the provision more protective of your lawful rights that is consistent with applicable law prevails.
Article 9 Protection of Minors and Guardian Consent
1. We take the protection of minors seriously. A minor and their parent or guardian should read these Terms and the Privacy Policy together and obtain any guardian consent required by applicable law before using SCENPOP.
2. When you use or access the service in any capacity, you represent that you meet the minimum age required to consent to data processing under the rules applicable to you and that applicable law does not prohibit you from using the service. If you are below the age of majority where you live, you represent that you have permission from your parent or guardian and that, where required by applicable law, your parent or guardian has read and accepted these Terms on your behalf. A parent or legal guardian is responsible for a minor's use of the service to the extent required by law. If the service provides specific features for different age groups as permitted by law, we will separately explain the applicable age and consent requirements.
3. Whether guardian consent is required, the applicable minimum age and the appropriate method of age confirmation depend on the law where you live, your actual age, the features offered and the nature of the personal information processed. We will not make identity documents or sensitive age verification a general condition of use beyond what is necessary.
4. A minor and their guardian may, where permitted by law, access, correct or delete information, withdraw consent or make a request concerning the account or personal information. We will verify requests in a proportionate manner and respond in accordance with law.
5. If we learn that we processed a minor's personal information without consent where consent was required, we will stop the processing and delete or otherwise handle the information as permitted by law. We may retain information only for the necessary period where required for security, fraud prevention, dispute resolution or legal compliance.
6. If the service later offers interaction, social, publishing, purchasing or time-management features that require additional protection for minors, we will assess applicable market laws, the actual audience and the risks and add appropriate measures before activation. The current text does not replace any consent process or protection required at that time.
7. This Article does not affect mandatory rights of children, guardians or consumers under the laws of the United Kingdom, Canada or your habitual residence, and does not restrict complaints to regulators or other lawful remedies.
8. The current version does not provide top-ups, memberships, virtual items, advertising, push notifications, social sharing or paid time-management features and therefore does not operate an anti-addiction system based on spending or time spent. We do not describe inactive features as available.
9. If a future feature could materially affect minors' rights, we will assess the target market, actual audience and risks and decide whether age confirmation, guardian consent, use notices or other safeguards are needed before activation.
10. If a guardian makes a request to access, correct, delete, restrict processing or withdraw consent under applicable law, we will verify the necessary identity and scope of the request and act in accordance with law. Verification will not collect sensitive material unrelated to the request.
11. If applicable law requires us to provide a guardian with necessary information about a minor's account, we will do so only for a lawful purpose, within the necessary scope and with adequate protection for other individuals' rights.
12. If a situation requires restricting features, suspending an account or deleting information, we will consider the best interests of the minor, information security, investigative needs and applicable law, and will explain the reasons and available remedies to the minor or guardian where practicable.
13. If the target market, actual audience or service content changes, we will review the minimum age, age confirmation, guardian consent and child-privacy measures before public release and will not rely indefinitely on arrangements intended only for controlled review or testing.
14. This Article should be read together with the minors section of the SCENPOP Privacy Policy. If they differ, the provision more protective of minors' lawful rights that is consistent with applicable law prevails.
Article 10 Our Rights and Obligations
1. We will provide SCENPOP through the internet and other necessary technical means in accordance with these Terms and the actual features of the service.
2. The current version does not provide commercial promotion or marketing notifications. This does not prevent us from sending necessary service and security notices through app pages or email.
3. We may analyse operational records, error information and user reports where necessary, lawful and proportionate to security purposes, in order to identify security risks, fix faults and determine whether these Terms have been breached.
4. If we identify unusual data, unlawful conduct or a breach, we may conduct a reasonable investigation and take proportionate measures, including warnings, feature restrictions, suspension or termination, removal of content required by law and lawful pursuit of responsibility.
Article 11 User Rights and Obligations
1. You must provide the compatible devices, software and network connection needed to use the service and keep your devices reasonably secure.
2. You are responsible for network, device and other costs associated with your use of the service, unless applicable law or a separate agreement provides otherwise.

(8) signing in to or controlling the service through unauthorised software, hardware, proxies, network accelerators or robots;
(9) exploiting technical defects, misconfiguration or unreasonable settings to obtain improper benefits for yourself or another person; or
(10) modifying communication protocols, bypassing access controls or altering runtime data to avoid security measures.
4. To protect service security, stability and users' lawful rights, you must not conduct unauthorised automated access, data scraping, bulk export or other activity that may create an unreasonable load, including by:
(1) using crawlers, scripts, robots or other automated tools to access the service without authorisation;
(2) bypassing sign-in verification, access limits, rate limits or other security controls;
(3) carrying out stress tests, denial-of-service attacks or similar interference against the service, network or infrastructure;
(4) copying, scraping, exporting or collecting service data or other users' information in bulk;
(5) using automation to evade account, device or regional restrictions;
(6) using automated tools to make repeated support, report or other requests and cause resource abuse;
(7) using the service to develop, train or test an unauthorised substitute or competing service;
(8) obtaining or inferring another user's non-public information by technical means; or
(9) otherwise compromising access controls, service stability or data integrity.
5. You must not circumvent security, geographic, age or technical restrictions without authorisation or assist another person to do so.
6. If we identify unusual access or a security risk, we may conduct a reasonable investigation. A lawful visit does not mean that we approve its purpose, automated scale or continuation.
7. Third-party software, plug-ins, scripts, hardware or services may affect the security of your device, data, account and the service. You should assess the risks, but these Terms do not exclude liability that we are required by law to bear.
8. If content or account entitlements involve theft, fraud, infringement or another unlawful act, we may, after lawful verification, restrict access, remove content or take other necessary measures.
9. To protect service security and order, we may reasonably investigate unusual access, suspected unlawful activity or suspected infringement and take proportionate measures based on the findings.
10. A completed visit, saved content or successful security check does not mean that we approve the relevant purpose, method or continuing status.
11. You must not:
(1) impersonate the service, system, an administrator or personnel, or spread false information or otherwise deceive others;
(2) harass personnel, send requests without substance, repeatedly submit resolved matters or abuse personnel;
(3) disrupt public order, threaten others, incite abnormal gatherings or otherwise endanger safety;
(4) induce fraud, obtain information or exploit security vulnerabilities;
(5) ignore reasonable security guidance or enforcement measures lawfully issued by us;
(6) help or assist another person to use third-party tools to access an account, alter data or circumvent security;
(7) steal accounts, data or personal information, or assist another person to operate a stolen account;
(8) use false promises, concealment, misleading names or impersonation to obtain information, property or access; or
(9) otherwise circumvent these Terms, infringe another person's lawful rights or endanger service security.
12. If conduct may be unlawful, we may retain necessary records to the extent permitted by law, assist competent authorities and notify affected parties where doing so would not impede an investigation or endanger others.
13. Conduct not listed in this Article but clearly unlawful, fraudulent, infringing or harmful to service security is also subject to these Terms. We will respond according to the nature and impact of the conduct, each party's fault and applicable law.
Article 13 Interruption, Suspension and Termination of Service
1. We may suspend or terminate all or part of a user's access if that user breaches these Terms, applicable law or security rules.
(1) If a user distributes unlawful information or seriously violates law or public-safety requirements, we may lawfully restrict or terminate the relevant service immediately.
(2) We may suspend or terminate for breach only under these Terms or rules that were clearly published in advance and are lawful.
(3) If you provide false registration information, breach these Terms or create a security risk, we may suspend all or part of the service. When doing so, we will explain the reason, duration or effective time and act reasonably.
(4) If a suspension period ends and you have corrected the issue, we will restore service promptly unless the law requires continued restriction.
2. The following rules apply to operation, maintenance, interruption, suspension and termination:
(1) We may perform planned or emergency maintenance and will seek to minimise interruption.
If service is interrupted because of planned maintenance, software or hardware updates, network or device failure, system attacks, communications failure, legal requirements, third-party causes or force majeure, we will make reasonable efforts to reduce the impact and bear responsibility as required by law.
(a) We will give advance notice of planned maintenance where possible and explain emergency maintenance promptly afterwards.
(b) If servers, networks or systems are attacked, damaged or cannot operate normally, we will take reasonable response measures.
(c) If software, hardware or communications equipment fails, we will make reasonable efforts to restore service.
(d) If a network provider or other infrastructure fails, we will coordinate within our reasonable control.
(e) Emergency measures lawfully taken to protect life, health, property or public safety may cause short service interruptions.
(f) Third-party causes or force majeure may affect the service. We will fulfil our legal duties concerning notice, mitigation and remediation.
(2) If we intend to stop all or part of the service, we will give advance notice according to applicable law and the impact, and provide reasonable arrangements for data processing, deletion or export.
(3) Termination does not affect rights and obligations already arising under law, and does not exclude your right to seek refunds, compensation or other remedies for non-performance.
Article 14 Appreciation System
The current version does not provide an appreciation system, rating challenges, leaderboards or appreciation interactions between users. If such features are introduced, we will explain the rules, data processing, appeal mechanism and applicable user protections before activation and will not treat the existing text as a substitute for necessary notice or consent.
Article 15 Standalone Application
The current version is a mobile application that requires a connection to the service. Offline saving and restoration are limited to the scope described in the app.
If a standalone mode is introduced, we will explain the boundaries for offline data, device storage, updates and restoration before activation.
Article 16 Test Area
The current version does not provide a test area, closed beta area or dedicated area for users to assist with testing. If a test area is introduced, the following boundaries will apply.
Test content may be temporary, and the available features and period will be explained before entry.
We may adjust features, settings and test data in a test area, while seeking to avoid affecting production data and protecting user rights in accordance with law.
If testing requires deletion of all or part of the test data, we will explain the scope, timing and backup arrangements in the test rules.
A test area may be limited to particular participants, devices, regions or access conditions. Those restrictions must be disclosed in advance and comply with applicable law.
Test servers may be temporarily unavailable for maintenance, updates or testing arrangements. We will provide a reasonable explanation.
We may modify a test environment for testing purposes, but will not use test rules to improperly exclude rights you have under applicable law.
If the test rules set out how long-inactive test accounts are handled, we will explain this in advance and provide reasonable notice before taking action.
Before participating in a test, you should read the test rules. If additional confidentiality requirements apply, you must comply with them, but confidentiality obligations do not restrict lawful complaints, contact with regulators or access to legal remedies.
Article 17 Enforcement Measures
Unless these Terms provide otherwise, if a user breaches these Terms or other applicable rules, we may take one or more measures based on the nature, seriousness and impact of the breach and each party's fault, including:
(1) warning the user and explaining the breach and necessary remediation;
(2) restricting features for a reasonable period;
(3) removing content that is clearly unlawful, infringing, fraudulent or harmful to service security;
(4) restricting access by an unusual account for a reasonable period or limiting access to particular features;
(5) suspending an account for the period needed for investigation, remediation or security handling;
(6) terminating an account where the breach is serious or repeated, or continued use would endanger others or service security;
(7) deleting or anonymising data that is required by law to be removed, unlawfully obtained or otherwise required to be deleted;
(8) pursuing legal responsibility where a user's conduct harms another person, us or a third party, or violates applicable law;
(9) requiring or lawfully resetting a name that may impersonate an official body, mislead others or infringe rights;
(10) restricting devices or access sources where verified continuing attacks, bulk abuse or serious security risks exist;
(11) temporarily restricting service channels that involve abuse risks;
(12) retaining necessary records to prevent further harm, handle complaints or comply with legal obligations;
(13) requiring the user to stop the breach, remove material or take other remedial action within a reasonable period;
(14) providing notice and explanation of the nature, main reasons, effective time, impact and appeal route where required by law; and
(15) taking other necessary measures proportionate to the breach, its impact and applicable law.
Before taking enforcement action, we will explain the reasons and give an opportunity to correct the issue where reasonably practicable.
In an emergency, where continued service may endanger others or impede an investigation, we may take necessary measures first and explain promptly afterwards.
Our measures will be proportionate to the breach, risk and actual impact. We will not impose the most severe measure for a single minor issue.
If you believe an enforcement measure is wrong, you may appeal using the contact details in these Terms.
We will review appeals reasonably and respond promptly where doing so would not affect security or an investigation.
The appeal process does not prevent you from complaining to a regulator or seeking a court remedy under applicable law.
Article 18 Account Recovery
If you cannot access your SCENPOP account, you may follow the app instructions to verify and restore it using your registered email address.
If automatic recovery is unsuccessful, you may submit the necessary information that reasonably demonstrates control of the account through the contact details in these Terms. We will handle the request after reasonable verification.
Our personnel will not ask for your email verification code, password or complete sign-in credentials through the app, email or another unsolicited contact. Be alert to messages or phishing links that impersonate us.
Article 19 User Account Protection Rules
If you report that an account has been stolen, impersonated or accessed unusually, or if we detect signs of unusual access, we may review the account and necessary security records and impose temporary sign-in restrictions or other protective measures during an investigation.
You should cooperate with reasonable checks. If unusual activity cannot be resolved because you do not cooperate or for reasons outside our reasonable control, the consequences will be handled according to each party's fault and applicable law. We will perform our security and personal-information protection duties in accordance with law.
Article 20 Use of Application Screens
Without our prior written permission, you must not publicly display, copy, distribute, transmit, play or otherwise use all or part of the application screens, screenshots, screen recordings or related visual materials from the SCENPOP software, except where expressly permitted by law. This Article does not affect your lawful rights in content you create or import.
Article 21 Damages
You must ensure that content you create, import, save or process through the service is lawful and does not infringe any third party's intellectual property, privacy, likeness, reputation or other lawful rights.
(1) If you believe content infringes your rights, you may notify us through the contact details in these Terms and identify the content you ask us to handle.
(2) The notice should include information reasonably sufficient to locate the content.
(3) The notice should include material sufficient to establish a prima facie showing that you own the rights or are authorised to act for the rights holder.
After receiving a compliant notice, we will decide whether to remove, restrict access to or take other reasonable measures based on the nature of the content, the evidence, applicable law and necessary procedures.
If a third party makes a rights complaint concerning your use of the service, we may take appropriate measures after verification and will where practicable notify you and provide a reasonable opportunity to respond or appeal.
If you violate applicable law or these Terms and cause actual damage, you are responsible to the extent required by law. If your conduct causes us actual loss, we may seek reasonable compensation in accordance with law, but will not claim amounts exceeding actual loss, unforeseeable loss or amounts that law prohibits us from claiming. These Terms do not exclude liability that cannot lawfully be excluded.
Article 22 Force Majeure
For events beyond our reasonable control that are unforeseeable or, if foreseeable, unavoidable, we may be excused from all or part of our performance obligations to the extent permitted by applicable law, but will take reasonable steps to mitigate the impact.
Force majeure may include natural disasters, serious social events, government action, major network or communications infrastructure failures, malicious attacks and other objective circumstances recognised by law. This Article does not exclude or limit consumer protection or personal-injury liability that cannot lawfully be excluded or limited.
Article 23 Third-Party Links
The current version does not provide advertising, commercial promotion, commercial referral or third-party promotional links, and we do not receive commission or other commercial referral revenue through the service.
If the app contains links to third-party websites, we will give reasonable notice before the redirect. The third party is responsible for the content, security measures and privacy practices of its website.
If you enter into a transaction or interaction with a third party through an external link, the relationship is between you and that third party. Except where applicable law provides otherwise or we are at fault, we are not responsible for the independent acts of a third party.
Please assess third-party information and links carefully. If you find a suspicious link or a message impersonating us, tell us promptly through the contact details in these Terms.
Article 24 Limits on Information Storage and Security Services
We will use reasonable measures appropriate to the nature of the information, processing risks and the actual service to maintain security and availability. However, internet transmission and storage cannot be guaranteed to be completely free from interruption, error or unauthorised access.
If data loss, service interruption or a security incident occurs, we will take reasonable remediation, mitigation, notification and reporting measures according to applicable law and the nature of the event. These Terms do not exclude or limit liability that we must bear under law.
Article 25 Changes to These Terms
We may revise these Terms because of changes to the service, legal requirements or security needs. Revised Terms will be published on an appropriate page with an updated date. If a revision materially affects your rights or obligations, we will provide advance notice through an in-app page, the sign-in page, the registered email address or another reasonable channel, and obtain your consent where required by law. If you do not agree, you may stop using the service and delete your account in accordance with law. Continued use does not remove rights granted to you by applicable law.
Article 26 Software Data
Account data, service configuration and necessary operation records generated during your use of SCENPOP are used for account identification, service operation, security protection, troubleshooting and compliance with legal obligations. We process personal information contained in those records in accordance with the Privacy Policy. Aggregated data that does not identify an individual may be used to improve the service but will not be used for unrelated improper commercial purposes. You may access, correct or delete information that may lawfully be processed in accordance with the Privacy Policy.
Article 27 Notices
We may send necessary service, security and contractual notices through app pages, the sign-in page, website announcements or the email address registered to your account, including notices about account security, material changes to these Terms, suspension or termination of the service and personal-information rights.
Article 28 Other Provisions
1. Headings are for convenience only and do not affect the meaning or interpretation of these Terms.
2. If a competent authority finds that any provision is wholly or partly invalid or unenforceable, the remaining provisions will continue in effect. The parties should replace the affected provision with a valid provision that comes closest to its original purpose to the extent permitted by law.
3. Our failure or delay in exercising a right under these Terms or applicable law is not a waiver of that right and does not affect its later exercise.
4. These Terms are formed, performed and interpreted under the laws of the Hong Kong Special Administrative Region, without excluding mandatory consumer or personal-information rights under the laws of the United Kingdom, Canada or your habitual residence that cannot be excluded by contract.
5. The parties should first try to resolve a dispute in good faith. If no resolution is reached, either party may bring proceedings before a court with jurisdiction or complain to a regulator in accordance with law. These Terms do not restrict your right to seek a remedy before a local court and do not exclude liability for fraud, wilful misconduct, death or personal injury, or other liability that cannot lawfully be excluded.
